Terms of Service

Wevilly is in pre-alpha.

This is early, experimental software. Features may change or break, the service may be unavailable at times, and your data may be reset or deleted at any time without notice as we build. No payments are processed on Wevilly during the pre-alpha. Use it at your own risk, and please send feedback through the in-app widget.

These Terms of Service (the “Terms”) are an agreement between you and Wevilly (“Wevilly,” “we,” “us,” or “our”) governing your access to and use of the Wevilly website, apps, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Wevilly

You must be at least 16 years old (or the age of majority where you live, if higher) to use the Service. By using Wevilly you represent that you meet this requirement and that the information you provide is accurate. During the pre-alpha, access is invite-only; you may need a valid invite code to create an account.

2. Your account

  • You are responsible for your account, for keeping your password secure, and for all activity that happens under it.
  • Provide accurate information and keep it current. Do not impersonate anyone or misrepresent your affiliation with a person or organization.
  • One person, one account, unless we agree otherwise. Do not share your login.
  • Tell us promptly if you believe your account has been compromised.

3. What Wevilly is

Wevilly is a professional network for the creative industries. The Service includes: a social platform (profiles, posts, messaging, villages, and other social features); a marketplace where members list and discover creative services; and a job and opportunity board where members post and respond to casting calls, crew jobs, gigs, collaborations, and similar opportunities. Wevilly provides the platform that connects members — we are not a party to the arrangements, deals, hires, or transactions that members make with each other.

4. Your content

You keep ownership of the content you post — your profile, posts, images, listings, messages, and other materials (“Your Content”). By posting Your Content, you grant Wevilly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it solely to operate, provide, and improve the Service (for example, showing your post in the feed or your listing in the marketplace). This license ends when you delete Your Content or your account, except for copies retained in routine backups or as required by law, and except for content others have shared or that you posted publicly.

You are responsible for Your Content. You represent that you have the rights to post it and that it does not infringe anyone’s rights or violate these Terms.

5. Acceptable use

You agree not to:

  • Post content that is unlawful, harassing, hateful, defamatory, obscene, or that promotes violence or discrimination;
  • Harass, threaten, dox, spam, or impersonate other members;
  • Infringe anyone’s intellectual property, privacy, or other rights;
  • Post false, deceptive, or fraudulent listings, opportunities, or credentials;
  • Collect or scrape other members’ data, or use bots to access the Service, without our permission;
  • Interfere with, probe, or attempt to breach the security or integrity of the Service;
  • Upload malware, or use the Service to send spam or unsolicited bulk messages, including through the invite features;
  • Use the Service for anything illegal or in violation of these Terms.

We may remove content, and suspend or terminate accounts, that we reasonably believe violate these Terms or harm the community. Members can report content and other members through the in-app tools.

6. Marketplace, jobs, and dealings between members

Wevilly is a venue that helps members find each other. We do not process payments on the Service during the pre-alpha, and we are not a party to, and take no responsibility for, any agreement, hiring decision, service, payment, or transaction between members. Any arrangement you make with another member — including negotiating terms, exchanging money, or performing work — is solely between you and that member, arranged off-platform and at your own risk.

  • We do not guarantee the accuracy of listings or opportunities, the identity or qualifications of any member, or the quality, safety, or legality of any service or work.
  • Do your own due diligence before hiring, being hired, paying, or being paid. Use written agreements where appropriate.
  • You are responsible for your own taxes, licenses, permits, and legal compliance related to your work and dealings.

7. Intellectual property

The Service itself — including the Wevilly name, logo, design, and software — belongs to Wevilly and is protected by intellectual-property laws. These Terms do not grant you any rights to our branding or software except to use the Service as intended.

If you believe content on Wevilly infringes your copyright or other rights, contact us at support@wevilly.com with enough detail to identify the content and your claim, and we will review and respond.

8. Third-party services

Wevilly relies on third-party providers (for example, hosting, email delivery, image hosting, maps, and error monitoring) to run the Service, and may link to third-party sites. We are not responsible for those third parties or their content, and your use of them may be governed by their own terms.

9. Pre-alpha; “as is”; no warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. As stated at the top, Wevilly is pre-alpha software: it may be unstable, incomplete, interrupted, or discontinued, and your data may be reset or deleted at any time without notice. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Wevilly and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or for any dealings between members. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to indemnify and hold Wevilly harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, your dealings with other members, or your violation of these Terms or of any law or third-party right.

12. Termination

You may stop using the Service and request account deletion at any time by contacting us. We may suspend or terminate your access at any time, including for violations of these Terms or to protect the community. Sections that by their nature should survive (such as ownership, disclaimers, limitation of liability, and indemnification) will survive termination.

13. Changes to these Terms

We may update these Terms as the Service evolves — which, in the pre-alpha, may be often. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree that the courts located there will have jurisdiction over any dispute that is not otherwise resolved.
